Klivr Labs Policy

1. Klivr Labs Terms of Service (ToS)

1.1. Introduction and Scope

These Terms of Service (the “Terms”) govern your access to and use of the Klivr Labs application (the “App”), developed by Klivr.com (“We,” “Us,” or “Our”). The App is primarily used for internal experimentation, development, and client demonstration of AI agents designed to interact with WhatsApp for Business accounts.

1.2. App Use Cases

The App is designated for two distinct purposes:

  1. Internal/Personal Use: To enable Klivr personnel (including the developer) to test, experiment with, and deploy AI agents for managing personal or internal WhatsApp for Business communications.
  2. Client Testing & Demonstration (Demo Use): To allow Klivr to showcase the capabilities of custom AI agents to prospective clients (“Clients”) using test/demo WhatsApp for Business accounts managed by Klivr. The App is not for public download or general consumer use.

1.3. User Responsibilities (Applies to Klivr Personnel & Clients in Demo Use)

By using the App, you agree to:

  • Use the App solely for the purposes defined in Section 1.2.
  • Comply with all applicable laws and regulations, including those related to data privacy and electronic communications.
  • Adhere to all WhatsApp and Meta Platform Terms and Policies. Any violation of these policies by your use of the App is your sole responsibility.
  • Ensure that any content or communications sent through the App (especially during Demo Use) do not contain illegal, harmful, threatening, defamatory, obscene, or harassing material.

1.4. Intellectual Property

  • App Ownership: Klivr.com retains all rights, title, and interest in and to the Klivr Labs App, including all related intellectual property rights.
  • Client Agent IP: Any custom AI agents developed by Klivr for a Client will be subject to a separate, written agreement governing intellectual property rights and ownership upon full commercial deployment.

1.5. Disclaimer of Warranties and Limitation of Liability

  • Experimental Nature: The App, particularly in its capacity for experimentation and demo use, is provided on an “as-is” and “as-available” basis. We make no warranties, express or implied, regarding its reliability, accuracy, or performance.
  • Limitation: To the maximum extent permitted by law, Klivr.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein.

1.6. Termination

We reserve the right to suspend or terminate access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

2. Klivr Labs Privacy Policy

This Privacy Policy describes how Klivr.com collects, uses, and discloses information in connection with the Klivr Labs App.

2.1. Information We Collect

Given the App’s nature as an internal tool and client demo platform, the type of information collected is limited and primarily related to the functioning of the AI agents.

a) Information from WhatsApp for Business: When the App is connected to a WhatsApp for Business account, we process the following data:

  • Message Content: The text and media content of messages sent to and from the connected WhatsApp Business account.
  • Metadata: Timestamps, message IDs, and the phone numbers of the senders/recipients.
  • Client Phone Numbers: Phone numbers that interact with the AI agent.

b) Usage Data: We may collect information on how the App is accessed and used, such as server logs, agent performance metrics, and error reports, strictly for debugging and performance optimization.

2.2. How We Use the Information

We use the collected information exclusively for the following purposes:

  • Internal/Personal Use: To enable the AI agent to accurately understand and respond to incoming messages on Klivr’s internal WhatsApp Business account.
  • Client Testing & Demonstration: To allow prospective Clients to observe and evaluate the performance of the AI agent in a simulated or test environment.
  • Development and Improvement: To analyze agent performance, debug errors, and improve the underlying AI models.
  • Compliance: To ensure compliance with all applicable laws and the Meta Platform Terms.

2.3. Data Storage, Security, and Retention

  • Storage: Data is processed and stored on secured servers located in [Specify your general data location, e.g., the EU/EEA and/or US].
  • Security: We implement appropriate technical and organizational measures to protect data from unauthorized access, disclosure, alteration, or destruction.
  • Retention: Data from Client Testing & Demonstration is retained only for the duration of the demonstration period and a reasonable period thereafter for testing verification (e.g., 30 days), unless a specific Client agreement requires longer retention. Data from Internal/Personal Use is retained as necessary for ongoing business operations.

2.4. Disclosure of Information

We do not sell or rent your personal information. We may disclose information only in the following circumstances:

  1. With Your Consent: For example, when you authorize us to use specific conversations as case studies (relevant only to Demo Use).
  2. Service Providers: To third-party vendors, consultants, and other service providers who require access to data to perform services on our behalf (e.g., cloud hosting, analytics). These providers are contractually obligated to protect the data.
  3. Legal Requirements: If required to do so by law or in the good faith belief that such action is necessary to comply with a legal obligation, protect and defend the rights or property of Klivr.com, or protect the personal safety of users.

2.5. Children’s Privacy

The App is not intended for use by individuals under the age of 18. We do not knowingly collect personally identifiable information from children under 18.
